Eligibility for disability benefits often changes over time, including the criteria necessary to maintain disability under the individual’s own occupation or any occupation policy stipulations. While it is not uncommon for an individual’s short-term health condition to improve over time, they may not achieve a health status sufficient to return to their prior work or to return to other suitable work with a comparable earning capacity.
Dr. Joy regularly evaluates denials of long-term disability claims, particularly among individuals who cannot return to their prior work, but can perform limited alternative work. These individual’s often continue to remain eligible for their long-term disability benefits.
